JUST IN: Adelabu, Makinde Head To Supreme Court As Appeal Court Sets Aside Tribunal Judgment

The candidate of the All Progressives Congress (APC) in the last gubernatorial election, Oloye Bayo Adelabu and Governor Seyi Makinde may head to the Supreme Court for final verdict of the electoral matters, Insideoyo.com has gathered.

This is coming as the Appeal Court sitting in Ibadan on Monday set aside the tribunal judgment which upheld Makinde’s election last month.

The Court of Appeal, however, stated that if not for time frame, it would have ordered retrial.

InsideOyo.com gathered that the court could not make any consequential order which would have been to order a retrial by the tribunal because the time set and prescribed by the law for tribunals to hear the case has run out.

What does this judgment mean for Governor Makinde and Oloye Adelabu?

By the Court of Appeal judgement, Governor Makinde and Oloye Adelabu will head to the Supreme Court to finalise the issue.

The legal team of the two parties will have to prepare a strong defense in the suit and ensure their arguments are superior.

What Oloye Adelabu is asking for?

InsideOyo.com recalls that Oloye Adelabu is praying to the court that Makinde was not duly elected by majority of lawful votes, that the election was marred by over-voting. He also said that INEC failed to comply with the provision of Electoral Act.

 

Oyo Election Petition Tribunal Ruling

Also recall that the 3-man panel of the Oyo Election Petition Tribunal unanimously threw out Adelabu’s petition claiming he failed to prove the allegation of non-compliance, non-accreditation, over voting and corrupt practices and even fined him N200,000 for wasting the tribunal’s time.
