Ibadan Businessman Wins 21-Year Land Dispute Against King Zion, Adedibu

Twenty one (21) years after a legal tussle on the rightful owner of a property situated at No1, Lebanon Street, Dugbe, Ibadan, Justice Muftau A.Adegbola of the Oyo State High Court 4 on Wednesday ruled that the owner of King Zion Ventures Ltd, late (Pastor) Peter Asha failed to present any document to show that the property belongs to him.

The court dismissed all the claims of the, defendants, King Zion and granted all the reliefs of the claimant (Pelumi Foluwasho Ojo) as the rightful owner of the property on No 1, Lebanon Street, Dugbe Ibadan, where Pelly Foam is situated.

It could be recalled that in 2006, the owner of Pelly Foam, one of the occupants of the said property situated at No1, Lebanon Street, Dugbe, Ibadan was attacked by some thugs allegedly sent by late political warlord, Alhaji Lamidi Adedibu.

Pelly Foam went to court to challenge the attack, which was still in court till the demise of late Adedibu on June, 2008.

According to the Court on Wednesday, there are no recital to show that Olubadan ceded the land to the defendant or that indeed it has any link to the land.

The court therefore dismissed the claim of the defendant that was claiming rightful owner of the property situated at No1 Lebanon Street, Dugbe Ibadan.

The Court said exhibit ‘Q’ and ‘E’ tendered by the defendant, (King Zion Ventures Ltd.) were not registered.

Speaking with journalists after the judgement, one of the Lawyers to the defendant, (Pelumi Foluwasho Ojo) Barrister S.Oyedele Sanni said his client got judgement on the property situated at No 1, Lebanon Street, Dugbe, Ibadan because the documents submitted to court as exhibits by King Zion Ventures Ltd were not registered. “And the exhibits therefore cannot confer titles on any property.

“On our part, the documents submitted by us as exhibits were registered. We got the documents after the demarcation of the local government which ceded the property to Ibadan North West, where Pelumi Foluwasho Ojo got his documents, which were registered.

“The Court ruled that Exhibits ‘Q’ and ‘E ‘ which is their own titles were not registered and did not specify where their property was situated.

“The court further said that defendant failed to include or present the site plan and recital that indicated that Olubadan gave them the landed property.

“The court therefore granted all our reliefs that the land belongs to us”, Barrister Sanni said.
